• Maintenance Plans: Scheduled regular cleaning services (quarterly, bi-annual, annual)
• Gutter Cleaning: Additional service to protect solar investment
• Debris Removal: Clearing of leaves, bird droppings, and other obstructions
• Before/After Documentation: Photos and efficiency improvement data

Service Dependencies: Service effectiveness may depend on weather conditions, panel condition, system age, and manufacturer specifications. We use eco-friendly cleaning methods and professional equipment.

2. Client Responsibilities

To receive our services, you must provide accurate information and are responsible for:

• Providing safe and clear access to solar panels and property

• Being available or arranging access for scheduled appointments

4. Service Limitations and Expectations

While we provide professional cleaning services, you acknowledge that:

7. Service Guarantee

We stand behind our work with a satisfaction guarantee. If you're not satisfied with our service quality, we will return to re-clean your panels at no additional charge within 7 days of the original service. This guarantee does not cover natural resoiling, weather events, or new contamination after service completion.

8. Privacy and Data Protection

Your privacy is important to us. All information is governed by our comprehensivePrivacy Policy. By engaging our services, you consent to the collection and use of information as described in the Privacy Policy.

9. Service Termination

Either party may terminate service agreements with proper notice:

• One-time services: 24-hour cancellation notice required
• Service plans: 30-day written notice for termination
• Immediate termination for breach of terms or safety concerns
• Refunds for prepaid services calculated pro-rata

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE SPECIFIC ENERGY PRODUCTION INCREASES OR SAVINGS. RESULTS DEPEND ON MULTIPLE FACTORS INCLUDING PANEL CONDITION, WEATHER, AND SYSTEM SPECIFICATIONS BEYOND OUR CONTROL.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TOTAL SOLAR CLEANING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST ENERGY PRODUCTION, OR SYSTEM DOWNTIME, ARISING FROM OUR SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT PAID FOR THE SERVICE THAT GAVE RISE TO THE CLAIM OR $500, WHICHEVER IS GREATER. SOME STATES DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold Total Solar Cleaning harmless from any claims, damages, or expenses arising from: your breach of these Terms, your violation of any law or rights of a third party, or your provision of false information about property conditions or hazards.

13. Governing Law and Disputes

These Terms shall be governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Contra Costa County, California.

Before initiating legal proceedings, parties agree to attempt good faith resolution through direct negotiation. For disputes under $10,000, parties agree to binding arbitration through a mutually agreed arbitrator.

14. Anti-Frivolous Litigation Provisions

To protect against abusive litigation, the following provisions apply:

Prevailing Party Attorney's Fees

In any legal proceeding, the prevailing party shall be entitled to recover reasonable attorney's fees and costs from the non-prevailing party. This applies to all disputes including contract, tort, or statutory claims.

Frivolous Claim Penalties

• Penalty for Frivolous Claims: Claims determined to be frivolous shall result in payment of our attorney's fees plus damages
• Pre-Filing Requirements: Before filing any lawsuit, you must provide 30 days' written notice and opportunity to cure
• Good Faith Requirement: All claims must be based on factual information and good faith belief

• New Law Compliance: 90-day grace period to implement new legal requirements

Our practices conform to industry standards for professional solar panel cleaning services. Claims alleging substandard practices must demonstrate departure from accepted industry standards and actual damages.

16. Intellectual Property

All content on our website including text, graphics, logos, and images is the property of Total Solar Cleaning and protected by copyright laws. Our service methods, processes, and customer information remain confidential and proprietary.

17. Force Majeure

We shall not be liable for any failure or delay in performing services due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the intent of the original.

19. Changes to Terms

We may update these Terms to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated with at least 30 days' notice through our website or direct communication.
